The competent authority will have to issue a Resolution pursuant to Article 60 of LO 4/2000, on the rights and freedoms of foreigners in Spain and their social integration, for the following reasons:
- Lack of a valid travel document.
- In possession of false/forged/altered travel document.
- Lack of a valid visa or residence permit.
- In possession of a false/falsified/forged/altered visa or residence permit.
- Lack of adequate documentation justifying the reason and conditions relating to their stay.
- Have already stayed ninety (90) days during the previous period of one hundred and eighty (180) days in the territory of the Schengen Convention Member States.
- Lack sufficient means of subsistence in relation to the period and modalities of their stay, as well as to return to the country of origin or transit.
- Be registered as ineligible in the SIS (Schengen Information System) in the National Registry.
- Being considered dangerous to public order, internal security, public health or the international relations of one of the Member States of the European Union.
It is worth mentioning that once the entry is denied by the officials in charge, they have the right to legal assistance, which may be ex officio or appoint a private lawyer (Lawyer at Molinares Abogados), and in case of requiring an interpreter, he/she will be assigned by the airport authorities.
