NOTE ON THE NEW RECEIPT FOR THE FILING OF AN APPLICATION FOR INTERNATIONAL PROTECTION
Today we bring the information note on the new receipt to be issued by the competent authorities to receive applications for international protection for foreigners who for various reasons cannot return to their countries of origin, taking into account the following issues:
TO WHOM DOES SPAIN GRANT INTERNATIONAL PROTECTION?
- Refugees, i.e. persons who have a well-founded fear of persecution in their own country on grounds of race, religion, nationality, political opinion, membership of a particular social group, gender or sexual orientation. Refugees are granted the right of asylum.
- To aliens who are not refugees but who cannot return to their country of origin because there are substantial grounds for believing that there is a real risk of suffering any of the following harms: - Death penalty. - Torture or inhuman or degrading treatment. - Serious threats to life or integrity as a result of situations of indiscriminate violence. These persons will receive subsidiary protection.
If you are in one of the above situations and need protection from the Spanish authorities you must file an application for international protection. The submission of the application involves the assessment of both situations by the Spanish authorities.
WHERE TO APPLY FOR INTERNATIONAL PROTECTION?
- If you arrive in Spain and cannot enter Spanish territory, at the border post.
- If you are already in Spain:
- At the Asylum and Refuge Office (OAR).
- At any Foreigners Office.
- At authorized Police Stations.
- In Centers of Internment of Foreigners.
WHEN SHOULD I APPLY FOR INTERNATIONAL PROTECTION?
If you are within Spanish territory within ONE MONTH from the date of entry into Spain or from the occurrence of the events justifying the request.
HOW TO APPLY FOR INTERNATIONAL PROTECTION?
The application is submitted in person. If you are unable to do so, due to physical or legal impossibility, you may authorize a person to do so on your behalf. It consists of an interview in which you will have to answer a series of questions about your personal data, explain all the reasons that lead you to request international protection and how you arrived in Spain. This interview will be conducted by a responsible person who will inform you on how to carry it out and will help you to complete it in order to establish the relevant facts.

We now transcribe the note published by the National Police, Ministry of the Interior, related to the new RESGUARD that will be delivered to applicants for international protection:
"The upward trend in the number of applications for international protection in Spain is particularly significant, which has required an adaptation of means, protocols and personnel dedicated to its processing.
This increase has generated in the same proportion an increase in the issuance of the document accrediting the status of applicant, in processing, International Protection (red card).
In order to reduce the waiting lists for the issuance of this document, the period of validity of the International Protection Application Form has been modified to 9 months, incorporating the work permit within the time prescribed by law.
This receipt will come into effect from the moment of the resumption of the formalization of the applications for International Protection in Spanish territory.
Attached is a model of the new "Resguardo de Presentación de Solicitud de Protección Internacional".

NEW DEVELOPMENTS IN THE RECEIPT FOR FILING AN APPLICATION FOR INTERNATIONAL PROTECTION (ART. 18.1.A) LAW 12 OF 2009.
- If the application date has elapsed and 30 days have passed, and the resolution of non-admission for processing has not been notified, the application will then be extended the expiration date of that document (white receipt), up to 9 months from the date of the initial application.
- Pursuant to the twenty-first additional provision of Royal Decree 557/2011, of April 20, 2011, the applicant for International Protection shall be authorized to authorized to work in Spain under the conditions described in the additional provision itself after the 6 months in which the application for international protection was made.

At the expiration date (9 months) the holder must appear before the agency that issued it. In case of failure to appear on the date of expiration or failure to respond to communications sent to the registered address, the application will be filed, which will have the effect of invalidating the document certifying the application for international protection (white receipt).
- The receipt guarantees the non-return of the holder.
- The receipt is not valid for border crossing (EU Regulation 399/2016 of March 9 Schengen Borders Code and Agreement on the Accession of Spain to the Schengen acquis).
