Spanish nationality under the Law of Democratic Memory
The deadline to apply for Spanish nationality pursuant to the provisions of Law 20/2022, of October 19, of Democratic Memory (BOE of October 20) is coming to an END.
Who can benefit:
- Grandchildren and children of Spaniards of origin (Annex I)
- Children born abroad to Spanish women who lost their nationality because they married foreigners before the entry into force of the 1978 Constitution (Annex II).Annex II)
- Sons and daughters of legal age of those Spaniards whose nationality of origin was recognized by virtue of the right of option in accordance with the provisions of the Law of Democratic Memory (Law 20/2022) or the so-called Law of Historical Memory (Law 52/2007) (see Annex III).Annex III).
- Persons who, being children of a father or mother originally Spanish and born in Spain, had opted for Spanish nationality not of origin by virtue of Article 20.1.b) of the Civil Code, as well as minor children of those who acquired Spanish nationality by application of the Law of Historical Memory, who opted, in turn, for Spanish nationality not of origin by virtue of the exercise of the right of option provided for in Article 20.1.a) of the Civil Code by virtue of being under the parental authority of a Spaniard, may now also avail themselves of the option contemplated in the eighth additional provision of the Law of Democratic Memory in order to obtain the Spanish nationality of origin(Annex IV).
The documents to be submitted will depend on the case that applies.We recommend, among others:
- Submit the application in person before October 21, 2024at the Civil Registry or Consulate of Spain nearest to the place of domicile of the interested party.
- In the Annex IIn Annex I, proof of exile is not required in all cases proof of exile.
- Before submitting the application, check that you have all the necessary documents, since the deadline for period of 30 calendar days is only 30 calendar days..
