Some weeks ago, we made a publication in our blog, in which we made reference to the allowed absences from Spanish territory, so we think it is important to mention the PUBLICATION of the Official State Gazette on March 04, 2024 of the Judgment of June 5, 2023, of the Third Chamber of the Supreme Court, which declares to uphold the appeal number 1843/2022, against the resolution of the Subdelegation of the Government in Girona, of November 18, 2019, by which it was agreed the extinction in its validity of the temporary residence authorization and work as an employee 2nd renewal.
Section FOURTH of said sentence declares NULL and VOID Article 162.2, paragraph e) of the Royal Decree 557/2011of April 20, which approves the Regulation of the Organic Law 4/2000, on the rights and freedoms of foreigners in Spain and their social integration, after its reform by Organic Law 2/2009, which indicated as a cause for termination of temporary residence absences from Spanish territory of more than six months in a period of one year.
This means that, as of today, absences from Spanish territory will not be taken into account for the purpose of renewing the residence authorization in Spanish territory.
