How do we see the situation today with DML Nationality applications?

Since the entry into force of the Law of Democratic Memory (LMD), many people have initiated the process to obtain Spanish nationality based on their family ties to exiles and descendants of Spaniards. The application for Spanish nationality by LMD has aroused great interest among those who wish to obtain Spanish citizenship by descent. However, as the process progresses, various experiences and learnings have emerged that applicants should keep in mind.

Experiences to date

The DML nationality application process has been met with great interest, but also with logistical and administrative challenges. Some of the most common experiences include:

  • Delays in processing: Despite the established deadlines, many consulates have received a large volume of applications, resulting in delays in the review and resolution of Spanish nationality files.
  • Lack of clear information: Depending on the consulate, the requirements and response times may vary, generating confusion among applicants for Spanish nationality by descent.
  • Cases resolved quickly: Some files have been processed relatively quickly, especially when the documentation is complete and well presented from the outset.

Difficulties in obtaining documents: Many descendants have encountered obstacles in obtaining birth certificates, marriage certificates and other essential documents to support their application for Spanish nationality.

Key points for applicants

For those who are in the application process or are about to start it, there are some fundamental aspects to consider:

  1. Gather all documentation in advance: Verify that the required documents are up to date, apostilled or legalized as appropriate to avoid delays in the Spanish nationality procedures.
  2. Consult directly with the corresponding consulate: Since criteria may differ by location, it is key to obtain updated information from the consular office where the application for Spanish nationality will be filed.
  3. Follow the established deadlines: The LMD has a limited period of validity for submitting applications, so it is important not to leave the Spanish nationality process to the last minute.
  4. Be informed about the specific requirements and possible complications: Although the process seems clear in theory, unexpected obstacles can arise in practice. Getting the right advice and learning about the experiences of other applicants can help avoid mistakes and speed up the process.
  5. Be patient and follow up: Given the high volume of applications for Spanish nationality, it is advisable to be attentive to any communication from the consulate and follow up on the processing when necessary.

While the process of applying for nationality under the Law of Democratic Memory has allowed many people to reconnect with their Spanish roots, it has also presented challenges that require organization and patience. The key to a smoother experience is to be well informed, prepared and proactive in following up on the file. In this sense, receiving specialized advice can make all the difference, as a professional with experience in Spanish nationality can help interpret the regulations, correctly complete the documentation and minimize the risks of errors that can delay the process.

  1. Dear Sir/Madam:

I am Ramon, from the Philippines. A mutual friend of ours, Evan Neuhoff from the United States, spoke very highly of you.

Here in the Philippines I have several acquaintances who are considering applying for Spanish nationality through the Democratic Memory Law, although many still have doubts. One such case is that of a person whose great-grandmother was Spanish born in the Philippines, but whose mother passed away in November 2021, shortly before the law went into effect.

I fear that upon filing the application it may be rejected, but I would like to know if you have had experience handling appeals or appeals in similar cases. I would also be interested to know if you can cite examples or file numbers where a favorable resolution has been achieved, especially when appealing to the spirit of the law and the restitution of historical memory.

I would very much appreciate knowing how much you charge for a consultation where we can discuss the more specific details of the case.

I look forward to hearing from you.
    Thank you in advance.

    Kind regards,
    Ramon
