Losing residency due to a denied renewal is becoming an increasingly common situation. Many people who have lived and worked legally in Spain suddenly find themselves in an irregular status, unsure of how to regain their authorization. You’ve worked, paid your taxes, and followed the rules. And yet, a denied renewal can leave you in an undocumented status overnight.
In this article, we analyze, from a technical and practical perspective, the two main alternatives in these cases:
• Second Chance Residency
• Social Residency
The goal is clear: to help you determine the best way to regain your residency.
📘 What is supervening irregularity?
This occurs when a person who previously held a residence permit loses it, usually due to:
• Denial of renewal.
• Failure to meet financial or contribution requirements.
• Termination of employment and lack of new employment.
• Failure to demonstrate sufficient financial means as a self-employed individual.
In such cases, the foreign national becomes undocumented, but with a prior history of legal residence, which is key to determining the most appropriate level of ties to the country.
💬 Second Chance Resettlement
This is a temporary residence permit granted under exceptional circumstances to citizens currently in Spain who held a residence permit during the two years prior to the date of application and whose permit was not renewed for reasons other than public order, public safety, or public health. IMPORTANT! The permit must be one that is eligible for renewal; not all types of permits qualify.
Key Requirements
• Not be an EU/EEA/Swiss citizen or a family member under EU law.
• Be in Spain.
• Have resided in Spain for two consecutive years prior to the application.
• Have no criminal record in Spain or in any other country within the last 5 years.
• Not be subject to a Schengen area entry ban.
• Not be subject to a non-return agreement.
• Not be an asylum seeker at the time of application.
• Pay Form 790, Code 052 (Section 2.3.1).
Important: The time spent as an applicant for international protection does not count toward the total until a final decision is issued.
What are the benefits?
This authorization does not require a mandatory employment contract. The grant automatically entails:
✔ Work permit for salaried employment
✔ Self-employment authorization
✔ No geographical or occupational restrictions
This is valid for one year, making it a very powerful tool for regaining legal status without necessarily having to rely on a previous employer. Furthermore, unlike the social integration requirement—which we’ll discuss next—you don’t need any integration report.
What documents are essential?
To obtain this authorization, you must provide:
- Model EX–10.
- Full passport.
- Proof of continuous residence for two years.
- Criminal background checks (legalized and translated if necessary)
How long does it last?
The initial validity period is one year. It may subsequently be converted to an initial residence and work permit, or extended annually if the holder can demonstrate that they are actively seeking employment and are registered with the public employment service.
💬 Social Roots
Social ties is a temporary residence permit granted on the basis of exceptional circumstances, which may be issued to foreign nationals who have been in Spain for a period of at least two years and have family ties in Spain or can demonstrate that they are integrated into Spanish society.
A two-year tenure is a key requirement. The tenure must be continuous for two years, with absences not exceeding 90 days during that period.
There are two paths one can take within the Social Roots program:
A) With family ties
The following must be present:
- Spouse or registered partner with legal residency.
- A first-degree relative in the direct line who is a legal resident.
And also:
- Provide proof of sufficient financial resources.
- Reach at least 200% of the IPREM (100% for the family member + 100% for the applicant).
The media must be available in Spain.
B) No family ties
If there are no family ties:
- A favorable report on social integration must be submitted.
- Issued by an autonomous community or a city council.
- It must be resolved within one month of the request.
This report assesses social participation, training, integration, and community ties
Economic Resources in Social Integration
Here is the key point: if you are relying on family financial resources, you must provide proof of sufficient income, and those funds must be available in Spain.
If you are self-employed, you must comply with Article 84 of the Regulations, in addition to proving sufficient capital and demonstrating professional qualifications, which can be verified through an assessment report issued by associations such as ATA, UPTA, OPA, CIAE, or UATAE. This is a much more technical and demanding process.
Which one should you choose if you've missed your renewal?
If your renewal was denied six months ago, you don't have a stable contract, or you don't have a family member with 200% of the IPREM, the Second Chance option is the most viable choice for you.
However, if you lost your residency more than two years ago and have a family member with legal residency and sufficient income, or if you have become well-integrated after living in Spain for two years, the "Arraigo Social" option may be right for you.
