During the 60 calendar days prior to the expiration date of the authorization to stay for study purposes and also within 90 calendar days after the expiration date. 90 calendar days after the expiration date. to that date. What if I already have a job offer?

In this case, you will be able to apply directly without the need to have this type of residence. However, this offer -which must be related to your studies- will pass the filter of the National Employment Situation, so it will be very difficult to succeed unless the job is one of the occupations that are difficult to fill or has a negative certificate from the SEPE. However, if you are a Peruvian or Chilean student, you will be exempted from this filter, as in other cases contemplated by law where it does not apply (art. 40. Law 4/2000).

How long does this residency last?

The authorization will have a maximum and non-extendable duration of twelve months. It shall take effect from the day following the expiration of the previous authorization of stay.

What happens when I reach your term?

Once you have been granted and resided with the residence permit in search of employment or to undertake a business project for 12 months*, you have several possibilities.

  • You can apply for authorization of residence and work as an employee if you find a job offer. if you find a job offer. However, any job offer.
  • You can apply for residence and self-employment authorization if you decide to if you decide to undertake a business project.
  • Re-apply for the authorization of stay for study purposes.

Normally, for the non-application of the national employment status, foreigners are required to have been in Spain for at least one year (12 months) in a residence situation; however, this period may be shorter, exceptionally, if the foreigner proves a need to work due to supervening circumstances in order to guarantee his/her subsistence.

 What happens to family members?

The family members who may accompany the holder of a residence authorization to seek employment or undertake a business project must be those who were already in Spain and who had obtained a previous visa or authorization to stay as a family member of the student. were already in Spain and had obtained, therefore, a previous visa or authorization of stay as a family member of the student..

From our office we consider that this authorization has been a relief for many students. Years ago, they were forced to stay 3 years studying, looking for studies that often did not satisfy them to continue their legal stay in Spain. Now, with this new authorization, once the foreign student has finished his higher studies, he can continue legally in Spain looking for a job according to his academic training or, if necessary, start a business project, being able to work in a paid job, without having to rely on his savings or those of his relatives, and counting with this authorization for residence for the purpose of applying for Spanish nationality in the immediate future.
