Normally, for the non-application of the national employment status, foreigners are required to have been in Spain for at least 1 year in a residence situation; however, this period may be shorter, exceptionally, if the foreigner proves a need to work due to supervening circumstances in order to guarantee his/her subsistence.
What happens to family members?

From our office we consider that this authorization has been a relief for many students. Years ago, they were forced to stay 3 years studying, looking for studies that often did not satisfy them to continue their legal stay in Spain. Now, with this new authorization, once the foreign student has finished his higher studies, he can continue legally in Spain doing an internship to complete his academic training, being able to work in paid jobs without having to rely on his savings or those of his relatives, and counting with this authorization for residence for the purpose of applying for Spanish nationality in the near future.
