What is an internship contract?

Who can apply? 

The host company or entity in favor of the studentThe company or host entity in favor of the student, holder of a previous authorization of stay for studies, who has completed the studies in a higher education institution authorized in Spain and who has reached at least the Level 6 according to the European Qualifications Framework.

This level 6 is reached with "university education, higher artistic education, higher vocational training, higher professional education in plastic arts and design and higher sports education". This does not include higher technical studies, but it does include bachelor's degrees, higher degrees in artistic education and, of course, master's or postgraduate degrees and doctorates. 

How do I apply? 

Only by electronic means addressed to the Government Delegation or Subdelegation in the province of residence. This means that it is not possible to file through a public registry, because the application will be rejected. We have had cases of clients who have had this happen to them, so make sure of the form of presentation beforehand.

When is it presented?  

During the 2 years prior to the date of the application for the authorization or who is pursuing studies leading to a higher education degree. leading to a higher education degree.

What if I have studied abroad?

The studies may be in Spain or abroad. In the latter case and taking into account the dates of completion of these studies, the corresponding visa for internships will be requested. 

Important: the internship must be related to the studies carried out.

 

What documentation is provided?

• Application formon the official form (EX04) duly completed and signed (this form can be obtained at this link).
• Passport valid passport.
• Identity card of the foreigner in case of being a holder of stay (NIE)
• Proof of the date of completion of studies completion of higher education studies (diploma or receipt of application for the degree and/or transcript of grades).
• Internship contract including at least a description of the internship program, duration, conditions and supervision, hours and legal relationship.
• Accreditation of the economic solvency of the company (copy of the NIF/CIF and public deed of incorporation and representation, declarations made to the Treasury, certificate of being up to date with tax obligations with the Social Security, etc.).
• Private medical insurance private health insurance (no deductibles, no co-payments and with repatriation service).
• Proof of own economic means (by means of responsible declaration, bank certificate, bank movements...) that reaches 6.454,08€ per year, unless it accredits to have covered the lodging that will be demanded half of the previous amount.

How long does it take to resolve? 

The maximum term to resolve and notify will be 30 days.. If it is not resolved within the term, the authorization will be understood as granted by positive administrative silence. This is very beneficial given that normally the Administration does not respond in time, and therefore, from that date, it is understood as granted.

Once the application for the internship has been authorized or the maximum period for resolution has elapsed, the company may register the student with the Social Security and the student may begin the internship. If, on the other hand, the student is not or does not reside in Spanish territory, a visa must be obtained. 

How long does this residency last? 

The authorization of the internship contract shall have a minimum duration of 6 months but may not exceed 2 years. minimum duration of 6 months but may not exceed 2 years.. On the other hand, the hosting agreement will be for 6 months, renewable once up to 1 year in total.

What happens when you reach your term?

Once you have been granted, you finish the internship and you have resided with the internship residence permit for 1 year, you have several possibilities.

• If the host entity or your internship company wants to continue with you and makes you a job offer, you may apply for the modification of the residence permit for internships to the residence and work as an employee.
• If you do not continue with the internship company, you can apply by yourself for the residence and work authorization as an employee with another job offer, regardless of the position and the working day.
• You can apply for residence and self-employment authorization if you decide to if you decide to undertake a business project.

Normally, for the non-application of the national employment status, foreigners are required to have been in Spain for at least 1 year in a residence situation; however, this period may be shorter, exceptionally, if the foreigner proves a need to work due to supervening circumstances in order to guarantee his/her subsistence. 

 What happens to family members?

The family members who may accompany the holder of a residence authorization to seek employment or undertake a business project must be those who were already in Spain and who had obtained a previous visa or authorization to stay as a family member of the student. were already in Spain and had obtained, therefore, a previous visa or authorization of stay as a family member of the student..
