From Molinares Abogados we would like to inform our clients that the Portuguese Government has made a modification to the Decree-Law (Decree-Law 26 of 2022) that regulates the obtaining of the Portuguese nationality by Sephardic origin, where a special link or connection with Portugal is required for those citizens of the world to be able to obtain the Portuguese nationality.
The fact is that the law will come into force in September of this year, following the same conditions and normal procedures.
- It is necessary to mention that the amending decree states that the bond may be credited for the following reasons:- That the applicant is the owner of real estate in Portugal, susceptible to transfer by death.- That the applicant holds a lease, commodatum, tenancy, usufruct, among others, with respect to real estate in Portugal.- That the applicant demonstrates continuous travel to Portugal in recent years.
- That the applicant holds shares in commercial or cooperative companies in Portugal.
This new requirement comes into effect on September 1, 2022, meaning that all applications for nationality by Sephardic origin submitted before that date to the Portuguese Ministry of Justice will not have to prove any relationship or connection with Portugal.
Therefore, we inform all our clients who are processing their applications with our office and who have the process at the request of the Ministry of Justice that the modification issued does not affect their applications in any way and they can continue the process without the need to prove a link with Portugal.
Our current applicants who are at the stage of certifying their Jewish origin to the Israeli Community of Lisbon will be covered by the transition regime granted to them, so that they will not be required to prove a special relationship with Portugal.
In the case of applicants or interested parties who are still at the stage of preparing the family tree or collecting the documentation for the preparation of the genealogy report, we recommend that they take as little time as possible, so that they are not the recipients of the modification that the process will undergo.
All interested parties who wish to initiate the process of Portuguese nationality by Sephardic origin with our office as of June 15, 2022, must prove a special bond with Portugal.
In the near future, our office will be intermediating with companies and/or cooperatives in Portugal and our new applicants, so that they can accredit the requirement of linkage with Portugal, once it is in force.
