When a person is renewing or modifying his or her authorization, he or she will be in regular administrative status until the procedure is resolved.
Madrid, October 13, 2023.- The Ministry of Inclusion, Social Security and Migration has sent an instruction to all Aliens Offices in Spain to include a reference in the communications for the initiation of various procedures, reminding that the application for renewal, extension or modification of authorizations extends the validity of the initial authorization, of which the foreigner is the holder, until its resolution.
This is an official document issued by the Directorate General of Migration, which aims to provide security to foreigners in Spain by reducing the difficulties that, in many cases, arise when carrying out daily procedures that require checking their documentary situation.
With this measure, when a person renews, extends or modifies his or her authorization, it is possible that the corresponding TIE will have expired until the procedure is resolved, but he or she will be in a regular administrative situation. That is to say, and when applicable, he/she will be able to continue working and carrying out daily procedures with financial entities, lease extensions, supplies, etcetera. The incorporation of this legend offers foreigners security and documentary support to accredit before third parties (public or private) their situation in Spain in the corresponding cases. The legend to be included is: "The present resolution of admission to process this application extends the validity of the previous authorization until the resolution of the procedure".
And the procedures to be notified are those related to extensions of stay and residences; renewals of residence, residence and work, including unaccompanied minors and young people in foster care; long term or long term EU; modifications of initial residences and initial residences for exceptional circumstances.
