SOCIAL ROOTS WITHOUT AN EMPLOYMENT CONTRACT

What type of Authorization is involved?

The Arraigo Social is a temporary residence permit for exceptional circumstances that may be granted to foreign citizens who are in Spain for a minimum period of three years.

 

What are the general requirements?
  • Proof of at least 3 years of permanence in Spain: historical census records, transport pass records, medical reports, proof of money transfers, library card, membership card of associations, civil and/or commercial contracts, bank statements and/or transactions showing purchases in stores in Spain, courses or training programs carried out in Spain, among other means of proof.
  • For the purposes of calculating the continuous permanence, absences from Spain may not exceed 120 days in a period of three years.
  • No criminal record in the countries in which he/she has resided the last 5 years prior to entry to Spain.
Is it possible to apply for Arraigo Social without providing an employment contract?

Yes. The body issuing the social insertion report may recommend that the foreigner be exempted from the need to have an employment contract, provided that he/she can prove that he/she has sufficient economic means that represent at least 100% of the amount of the guaranteed income of the Minimum Vital Income -IMV- on an annual basis..

It is worth mentioning that the means may come from a legal resident relative with whom he/she lives. These economic means of the applicant will be equivalent to 100% of the income guaranteed by the IMV, considering the applicant's cohabitation unit. 

*The MVI for the year 2023 is 6,784.44 euros per year, i.e., 565.37 euros per month. *The MVI amounts vary from year to year.

 

Does the residence authorization for Social Rootedness without a work permit come with a work permit?

The residence permit for social roots, without providing a work contract, will only authorize residence, but will not come with a work permit.

How long has the authorization been in effect?

The term of the authorization shall commence upon notification of the resolution granting the authorization.

 

How long is the authorization valid?
The authorization granted will be valid for one year and upon its expiration, a residence authorization or a residence and work authorization may be requested.
