These are the main changes in the student regime since the entry into force of Royal Decree 629/2022, of July 26, amending the Regulation of Organic Law 4/2000, on the rights and freedoms of foreigners in Spain and their social integration, after its reform by Organic Law 2/2009, approved by Royal Decree 557/2011, of April 20. Thanks to these modifications, it is now easier to obtain residence and work permits, creating advantages, among many others, for foreign students.
1. Automatic work permit for employed or self-employed persons
Provided that the studies are:
- Higher education
- Formal training for employment
- Training aimed at obtaining a certificate of professionalism or technical aptitude.
- A professional qualification required for access to a specific occupation.
2. Increased working hours
Undoubtedly, a great benefit for students is the increase in working hours to a maximum of 30 hours per week, as long as the workday is compatible with the academic activity.
3. Without geographical limitation to exercise the labor activity.
This means that students can work anywhere in Spain, unless the gainful activity coincides with periods during which they are studying.
4. Modification of the status of stay for studies, research, training or internships to the initial status of residence and work as an employee.
Another approach of the government to facilitate the employment of foreign workers and make it easier to obtain work permits is to expedite the review of study visas to residence and work visas. Therefore, with the approval of the new law, the 3-year requirement of the requirement of 3 years of stay is eliminated The new law eliminates the requirement of 3 years in a stay situation, being able to request the modification to work residency upon satisfactory completion of studies.
