LABOR ROOTS AND ITS NOVELTIES ACCORDING TO THE REFORM OF THE REGULATIONS OF THE LAW ON FOREIGNERS

1. Who can apply? Foreigners who are irregularly present in Spain and who have an employment relationship of at least 6 months.

 

2. Is it necessary to prove a minimum length of stay in Spain? Yes. Two (02) years of permanence in Spain. It is not possible to be absent from Spanish territory for more than 90 days in the last two years prior to the application.

 

3. Can it be any type of employment relationship? No. LEGAL labor relations must be accredited, that is to say, carried out in a situation of legal stay or residence, in the last 2 years.

 

4. Does the working day have to have a minimum duration? Yes. It will depend on whether the work activity is employed or self-employed. If the work activity is for employed by others must have a 30 hours per week in a six-month period or 15 hours per week in a 12-month period. In the case of self-employment self-employmentIn the case of self-employment, a continuous activity of at least six months must be accredited.

 

5. How is the employment relationship and its duration accredited? Through any legally admissible means of proof.

 

6. Is it necessary to provide the Certificate of Criminal Record of the country of origin and country of residence for the last 5 years? No. If the applicant has not resided in the last five years in his/her country of origin, it will not be necessary to provide such Certificate. In that case, only the Criminal Record Certificate of the country in which he/she has resided prior to his/her entry into Spain will be required.

 

7. How long is the Residence Authorization valid? The authorization granted will be valid for one year and at the end of this period it will be possible to apply for a residence authorization or a residence and work authorization.
