ROOTING FOR TRAINING

Arraigo for training is the new figure created by the Regulation of the Immigration Law, which seeks the regularization of foreigners who have been in Spain for at least 2 years on a continuous basis and who are interested in training in Spain so that once they have completed their training they can access the Spanish labor market in a job related to their studies.
1. What are the requirements to apply for training roots?
  • Continuous residence in Spain for a minimum of 2 years. 
  • No absences of more than 90 days
  • Lack of criminal record in Spain and in the countries in which he/she has resided for the last 5 years. If the applicant has not resided in the last five years in his/her country of origin, it will not be necessary to provide the Criminal Record Certificate of the country of origin. The Criminal Record Certificate of the country in which he/she has resided prior to his/her entry into Spain will suffice * This applies to all residence authorizations for reasons of roots.
  • Undertake to carry out a specific training program as provided for in the Law.
2. What type of training is valid to apply for training roots?
  • Regulated training for those belonging to the Vocational Training System.
  • Training leading to the attainment of a certificate of technical aptitude or professional qualification required for the exercise of a specific occupation.
  • A training program promoted by the Public Employment Services
  • Official Master's Degrees of the universities, courses to broaden or update competencies and training or professional skills in the field of continuing education of the universities, as well as other continuing education courses.

 

3. At what time should the registration be made? 

Within 3 months from the notification of the resolution granting the Residence Authorization.

In cases where enrollment is subject to specific enrollment periods, proof of enrollment must be submitted to the Aliens Office within a maximum period of 3 months from the end of the enrollment period.

4. How long is the residence authorization for training purposes valid? 

The residence permit for training purposes is granted for a period of 12 months. 

 

5. Is it possible to extend the residence authorization?

Yes. It may be extended only once for another 12-month period in cases where the training lasts longer than 12 months or its duration exceeds the term of the first authorization granted. 

6. Can this residence authorization lead to a work permit?

Yes. Once the training has been completed and during the period of validity of the residence permit, the interested party may submit the application for a residence and work permit to the Aliens Office by presenting a EMPLOYMENT CONTRACT signed by the worker and the employer.

 

  • The Employment Contract must guarantee at least the minimum interprofessional wage or that established by the applicable collective bargaining agreement.
  • The Employment Contract to be presented must be related to the training received and accredited in the roots.
  • Proof of having successfully completed the training foreseen in the residency application.
7. How long is the work authorization valid?

The authorization will be valid for a period of 2 years and will entitle the holder to work as an employee and will be subject to registration with the social security system.
