DECLARATION OF ENTRY TO SPAIN

According to art. 13 of Royal Decree 557/2011, of April 20, 2011, foreigners entering Spain from a country with which Spain has signed an agreement for the elimination of border controls are obliged to declare their entry in person to the Spanish police authorities.

If it has not been made at the time of entry, such a declaration must be made within three days of entry. three working working days from the date of entry at any police station of the National Police Corps or office of foreigners.

This official form allows the declaration of entry before the Spanish Authorities on the date of presentation, indicating the foreigner's data, the reason for the stay in Spanish territory and the expected length of stay.

This does not mean that every time we travel it is necessary to make the entry declaration, since if our passport is stamped with the entry stamp to Spain, it would be a proof that we have returned to Spanish territory.

  • Where do I make the entry declaration?

The person concerned must fill out the form provided to record the entry. Therefore, they will have the obligation to declare the entry to the Spanish police authorities.

  • How do I make the declaration of entry into Spanish territory?

The declaration must be made in person at the time of entry at the police post at the border. In the event that there is no such police post, the entry declaration must be made at any Police Station and Foreigners Office within 72 hours from the moment of entry.

  • Do I have to declare every time I leave Spain?

When the foreign citizen arrives at the authorized post with the necessary documentation and there is no prohibition or impediment to entry, the established control stamp, sign or mark will be stamped in the passport or travel document, unless the internal laws or international treaties to which Spain is a party provide for the non-stamping, with which, after returning the documentation, he/she will be allowed to enter the interior of the country. In short, it will only be necessary to make the declaration of entry when we come from a country with which Spain has an agreement to eliminate border control or stamp or sign in the passport or travel document, but this does not mean that every time we travel it is necessary to make the declaration of entry, since if our passport is stamped with the entry stamp, it would already be a record that we have returned to Spanish territory.

However, it may happen that in those cases where there is a border control, the passport is not stamped for any reason, in this case we must also make a declaration of entry, to avoid any inconvenience.
