LEARN HOW TO APPLY FOR YOUR EXTENSION OF STUDIES

Situation: You have a student visa, one year has elapsed since its issuance and you are looking to continue your studies in Spanish territory.

Next step: Apply for an extension of stay for study purposes. 

 

Time to apply: 
  • May be ordered within 60 days 60 days prior to to the expiration date of your alien identity card expiration date.

 

  • Within 90 days after such expiration, in this second case there is a risk of a fine if it is considered that a minor infraction has been committed in relation to foreigners. 
  • What are the requirements to obtain the extension of stay for studies?

    Article 40.1 of the Alien Regulations establishes that, "the authorization to stay may be extended annually when the interested party proves that he continues to meet the requirements set forth in Article 38, both of a general nature and specific to the activity for which he was authorized to stay in Spain.".

Article 38 requirements:

a) Have been admitted to an authorized educational institution for a full-time program for the completion of a full-time program;

It is essential that the program of study be "full-time, leading to the award of a degree or certificate of studies"(Article 38.2.a) of the Aliens Regulations). The expression "full time"should not be understood as "full time"in labor terms.

b) Economic solvency:

Article 38.1. 2.º of the Alien Regulation, in order to comply with the economic solvency requirement, it must be demonstrated to have "an amount that represents monthly 100% of the IPREM".

Currently the IPREM (Indicador Público de Rentas de Efectos Múltiples) is is 600 euros per month.

IPREM per year: 7,200 euros/year.

IPREM in annual computation annual computation (including pro rata of extraordinary payments): 8,400 euros.

c) Medical insuranceo for foreign foreign students in Spain;

d) Lack of criminal record;

Both those of Spain as well as those of those countries ".of residence during the last five years, for offenses provided for in the Spanish legal system"(Article 38.1.a) 5th of the Alien Regulation). That is, the criminal record does not necessarily have to be from the country of origin of the foreigner, but from those countries in which that person has been residing in the last 5 years.

This requirement only applies to those who are of legal age.. The criminal record certificate must be apostilled (if issued by a Hague Convention country). country that is part of the Hague Convention) or legalized, in case the issuing country is not part of the Hague Convention.

e) To have a medical or health certificate y;

The certificate attesting to the applicant's health status shall state that the patient tested, "does not suffer from any diseases that may have serious public health implications in accordance with the provisions of the International Health Regulations 2005.does not suffer from any of the diseases that may have serious public health repercussions in accordance with the provisions of the International Health Regulations 2005"(Article 38.1.a) 5th of the Aliens Regulations).

f) Have have passed the relevant or requirements for the continuation of their studies

This refers to having a PASSING grade in past studies. 

g) Having paid the fee

ATTENTION: to obtain the extension of stay for studies it is not necessary to provide the criminal record certificate of the country of origin or the medical or health certificate. However, it is advisable to present it.

Place of applicationThe extension of stay for studies must always be requested from Spanish territory. You must present your application and all the documentation at any public registry addressed to the Immigration Office or by telematic means.
