ROOTING FOR TRAINING

What is rooting for training?

Arraigo for training is a residence permit for exceptional circumstances of a duration equivalent to 1 year (it can be extended up to 2 years), which will allow a foreigner in an irregular situation to obtain a residence permit to study and train in Spain.

This new "arraigo" will be granted to all those immigrants who have been in an irregular situation for at least 2 years and who intend to start a regulated training that will allow them to obtain a degree after completing their studies; a degree that should allow them to practice in the corresponding profession, but not all courses meet the requirements for this type of "arraigo".

Is it possible to work with rootedness by training?

No, it is not possible to work with the "arraigo por formación". This residence for exceptional circumstances will only allow you to study.

 

Duration of the training period

The training residency will be granted initially for 12 months. However, as long as the studies that the foreigner initiates are extended for more than one year, the holder of this arraigo may renew this residence for exceptional circumstances for up to 1 extra year.

Or, if you find a job offer, modify the residency and work for others, which would allow you to get a work permit much more easily.

Continued residence in Spain

First, and in the same way as with any of the 3 existing figures of "arraigo", you must demonstrate a minimum of continuous residence, in an irregular situation, in Spain.

In this case we are talking about 2 years, and to do so you must use any valid proof. These proofs can be such as the census registration, the passport showing the entries and exits, purchase receipts, electricity or gas bills, membership cards of different clubs, etc.

Committing to start your studies

Finally, and most importantly, the foreigner in an irregular situation must commit to begin his or her studies in Spain. It is important to clarify this point: the foreigner must commit himself, but it is not necessary that he has already started his studies for this authorization to be granted. However, 3 months after the foreigner has obtained the authorization, he/she must have enrolled in an institution and provide proof of this, otherwise he/she will lose the authorization.

How to renew the rooting for training

As we have seen, the initial duration of 12 months of this residency can be extended or renewed. More specifically, you will be able to extend the arraigo for training purposes as long as:

-The duration of the studies is longer than 12 months.

-You have enrolled in training but have not successfully completed the training you had enrolled in, and you are still enrolled in it to complete it during the next year

 

-From training roots to work permits

 

Modification of residence and work

This new figure of "arraigo" would not make sense without the corresponding subsequent modification to residence and work. That is to say, after completing the studies for which the training has been granted, the foreigner will be able to obtain a work permit for 2 years, which can be renewed at a later date.

Thus, in order to carry out this procedure, you must find a company willing to hire you and a job offer. In order to be able to make this modification to residence and work as an employee, the following 3 requirements must be met:

-First of all, the job position must be related to the studies completed.

-The minimum gross salary must be equivalent to the minimum wage. 

-Demonstrate successful completion of the training, which must be demonstrated through a report from the educational center.

If I obtain an employment contract, can I interrupt the training and apply for the labor roots? 

No. Persons who apply for the "arraigo" for training will only be eligible for a work and residence permit once the training has been completed and passed.

 

Does this authorization count towards the application for nationality by residence? 

Yes, unlike the student visa, since it is a legal residence permit, its duration is contemplated for the subsequent application for nationality by residence.

 

Can I apply for arraigo if I will have been in Spain for two years next month? 

No. The requirement to have been in the country for a minimum of two years is one of the most important. In case of having stayed for a shorter period, the application is likely to be denied.

 

How long does it take Extranjería to provide a response? 

The usual time frame for the resolution of cases is a maximum of 90 days.
